Please read these Terms of Use (“Terms”, “Terms of Use”) carefully before using the https://lovekissedbookbargains.com website, https://lovekissedbooks.com website, https://mynextbookboyfriend.com website, and https://lovekissedforauthors.com (collectively, the Service) operated by Helping Authors Achieve Results, Ltd (HAAR) (“us”, “we”, or “our”).

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service. By accessing or using the Service, you agree to be bound by these Terms.

1. General Use and Accuracy

• Age Restriction: This Service is not intended for children under 18.
• Accuracy of Information: While we strive for accuracy, the content on this site is for general information only and can change without notice. Neither we nor any of our third-party providers offer a formal guarantee regarding the precision, performance, or suitability of this information.
• Limitation of Error Liability: You use this site with the understanding that it may contain mistakes or inaccuracies. We expressly exclude liability for any such errors to the fullest extent permitted by law.
• User Responsibility: Using the information or materials on this site is done strictly at your own risk. It is your sole responsibility to ensure that any products, services, or information available through this website meet your specific requirements.

2. Privacy Policy

3. Digital Products and Consignment

• Digital Sales: All sales of digital products (including premade plots and concepts) are final. Once a digital file is delivered or accessed, it is non-refundable.
• Due to the digital nature of our products, there are no refunds. Please make sure you know what you’re purchasing prior to submitting payment. We’re happy to answer any questions you may have about a product prior to purchase. If you should have any difficulty accessing a digital product, please reach out so we can assist you.
• Book Promotions (Newsletters and Website): Bookings are non-refundable once purchased. If you need to reschedule or cancel your promotion, you must notify us at least 14 days before the publication date to receive store credit toward a future booking. Cancellations made less than 14 days before the publication date are completely non-refundable.
• Consignment Agency: When acting as a consignment agent, HAAR facilitates the marketing and sale of intellectual property. Specific rights transfers and commission rates are governed by individual agent agreements, which supplement these Terms.

Statutory Right of Withdrawal for EU and UK Consumers

If you are a consumer residing within the European Union or the United Kingdom, you are legally entitled to a 14-day “cooling-off” period to cancel your purchase, subject to the specific conditions below:

1. Digital Sales: By purchasing and initiating the download or access of any digital content, you explicitly request immediate performance of the contract.

• Waiver of Rights: At checkout, you acknowledge and agree that you completely waive your 14-day right of withdrawal once the digital file download or access begins.
• No Refunds: If you have initiated the download or opened the digital access, no refunds or credits will be issued under any circumstances.

1. Book Promotion (Newsletters and Website): The 14-day withdrawal period begins on the day the promotion contract is concluded (the day you book and pay).

• Booking More Than 14 Days Before Publication: If your promotion is scheduled to run after your 14-day cooling-off window has closed, you may cancel for a full refund at any time within those first 14 days. Once Day 15 arrives, your statutory right expires, and our standard International Policy (Store Credit Only) applies.
• Booking Less Than 14 Days Before Publication: If your promoiton is scheduled to run immediately or within the 14-day window, you must explicitly agree to the immediate performance of the service at checkout.
  • If the service is fully performed (the newsletter is sent or the website promotion finishes) within the 14 days, you lose your right to cancel and no refund will be given.
  • If you cancel mid-campaign (before the service is fully completed), you are legally entitled to a proportionate refund for the unused days of the advertisement.

3. How to Exercise Your Right to Cancel (EU/UK Only)

To exercise your right of withdrawal within the legal 14-day window, you must inform us of your decision through a clear, written statement.

You can submit your cancellation request by emailing us at: support@lovekissedbooks.com.

Your email should include:

• Your full name
• Order/Invoice number
• Date of purchase
• Book Title
• A clear statement that you wish to withdraw from the contract.

We will process eligible refunds within 14 days of receiving your cancellation notice, using the same payment method you used for the initial transaction.

4. Intellectual Property

The Service and its original content (excluding user-submitted plots), features, and functionality are and will remain the exclusive property of HAAR and its licensors.

5. Force Majeure

HAAR shall not be liable for any failure or delay in performance under these Terms caused by events beyond our reasonable control, occurring without our fault or negligence. Such causes include, but are not limited to:

• Third-Party Failures: Outages or disruptions in third-party hosting, cloud providers, or internet services.
• Technical Disruptions: Systematic cyberattacks (DDoS), data breaches, or large-scale software failures (e.g., global “Blue Screen” events or faulty software updates).
• Acts of God: Natural disasters, pandemics, strikes, or government mandates. In such events, our obligations will be suspended for the duration of the occurrence.

6. Links To Other Websites

Our Service may contain links to third-party websites or services not owned by us. We assume no responsibility for the content, privacy policies, or practices of any third-party sites. You acknowledge that HAAR shall not be liable for any damage or loss caused by your use of third-party services.

7. Termination

We may terminate or suspend access to our Service or your account immediately, without prior notice or liability, for any reason, including if you breach the Terms. Upon termination, your right to use the Service will immediately cease.

8. Disclaimer and Limitation of Liability

Your use of the Service is at your sole risk. The Service is provided on an “AS IS” and “AS AVAILABLE” basis. HAAR, its subsidiaries, and its licensors do not warrant that the Service will function uninterrupted, be error-free, or be free of harmful components.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of the United Kingdom. Our failure to enforce any right or provision will not constitute a waiver of those rights.

10. Changes

We reserve the right to modify these Terms at any time. If a revision is material, we will try to provide at least 30 days’ notice prior to any new terms taking effect. By continuing to access our Service after revisions become effective, you agree to be bound by the revised terms.
